ALL products offered by Escape Climbing LLC (“Escape”) are sold and provided to you subject to the following terms and conditions. The terms and conditions set forth below are fundamental elements of the basis of the agreement between Escape and you (the “Buyer”). Buyer understands and agrees that Escape fills Buyer’s order(s) subject to the following terms and conditions and that Escape would not provide any product(s) to Buyer without Buyer’s agreement to these terms. By ordering and accepting any product(s) from Escape, Buyer irrevocably acknowledges Buyer’s assent to the terms and conditions listed below.

WARNING! CLIMBING, MOUNTAINEERING, BOULDERING, HIKING, RELATED ACTIVITIES AND TRAINING FOR SUCH ACTIVITIES ARE HAZARDOUS AND INHERENTLY DANGEROUS ACTIVITIES, THAT EVEN WHEN DONE PROPERLY, DUE TO THEIR PHYSICAL DEMANDS AND/OR FALLS SUSTAINED, MAY RESULT IN SERIOUS BODILY INJURY AND/OR DEATH. USE THESE CLIMBING HOLDS AND ESCAPE PRODUCT(S) AT YOUR OWN RISK. ALWAYS USE COMMON SENSE AND GOOD JUDGMENT. ESCAPE EXPLICITLY DISCLAIMS ANY AND ALL RESPONSIBILITY AND LIABILITY FOR ANY DEATH, INJURY, AND/OR DAMAGE TO ANY PERSON OR PROPERTY THAT MAY OCCUR, THAT ARISES OUT OF, OR IS IN ANY WAY RELATED TO THE USE OR MISUSE OF ESCAPE PRODUCT(S). BUYER AND USER ARE RESPONSIBLE FOR KNOWING AND RESPECTING ESCAPE’S PRODUCT(S) CAPABILITIES AND LIMITATIONS. BUYER, BY PLACING THIS ORDER, HEREBY AGREES THAT BUYER AND USER ARE SOLELY RESPONSIBLE FOR THEIR OWN SAFETY, AND BUYER AND USER ASSUME ALL RISKS AND ACCEPT FULL AND COMPLETE RESPONSIBILITY FOR ALL DAMAGES OF ANY KIND, INCLUDING ANY DEATH, INJURY, DISFIGUREMENT, AND/OR DAMAGE TO ANY PERSON OR PROPERTY, THAT ARISES OUT OF, OR ARE IN ANY WAY RELATED TO THE BUYER’S AND/OR USER’S USE OR MISUSE OF ESCAPE PRODUCT(S).

PLEASE NOTE indoor climbing is a different sport than outdoor climbing, each requiring individual techniques and safety procedures. While similarities exist between the two sports, the objective dangers are quite different. Seemingly small and insignificant mistakes may have catastrophic results that could result in serious bodily injury and/or death. Individuals and organizations using product(s) distributed by Escape bear the responsibility of learning the proper techniques and safety procedures required for their safe use. ALWAYS check the condition of the wall, hardware, handholds, and other climbing-related equipment prior to climbing. Any damage to or equipment showing signs of wear needs to be replaced prior to climbing. ALWAYS check handholds to ensure they are properly mounted, secured and undamaged prior to climbing. ALWAYS double check EVERYTHING. ALWAYS seek proper training and instruction before using products received from Escape. DO NOT use or install any climbing products (handholds, etc.) without proper knowledge and training of how the products are to be used. Resources like Escape’s website and publications can provide useful information and tips, but they are no substitute for good decision-making, safe and appropriate use of equipment, or professional instruction for the numerous hazardous situations in which you may choose to use Escape’s products. Buyer is solely responsible for determining whether Escape product(s) are suitable for Buyer’s use and situation and for the conditions onsite where the product(s) will be used. Buyer and/or buyer’s representatives and/or agents are solely responsible for knowing and performing the proper installation and use of product(s), and for ensuring that all installation and use of the product(s) is performed properly and in accordance with all relevant instructions. Buyer and/or buyer’s agents shall have the final approval and assume all responsibility for all such installation and use. ESCAPE HEREBY DISCLAIMS ALL RESPONSIBILITY FOR ANY CLAIMS, DAMAGES, OR LOSSES RELATED TO OR ARISING FROM SUCH INSTALLATION AND/OR USE/MISUSE. BUYER HEREBY RELEASES AND HOLDS ESCAPE HARMLESS FROM ANY INJURY ESCAPE SUFFERS THAT ARISES FROM OR IS RELATED TO, OR WHICH OCCURS AS A RESULT OF, BUYER’S BREACH OF THESE REPRESENTATIONS AND WARRANTIES. BUYER HEREBY AGREES TO INDEMNIFY, HOLD HARMLESS AND DEFEND ESCAPE, ITS SHAREHOLDERS, MEMBERS, DIRECTORS, MANAGERS, OFFICERS, EMPLOYEES, REPRESENTATIVES, AND AGENTS FROM AND AGAINST ALL LOSSES, LIABILITIES, DAMAGES, CLAIMS AND EXPENSES, INCLUDING ATTORNEY FEES AND COURT COSTS, ARISING OUT OF ANY CLAIMS OR SUITS FOR DAMAGE OR INJURY TO ANY PERSON OR PROPERTY BASED IN WHOLE OR IN PART ON, ARISING OUT OF OR RELATED IN ANY WAY TO, THE BUYER’S BREACH OF THESE REPRESENTATIONS AND WARRANTIES.
